SC Collegium recommends Sr. Adv Indu Malhotra & Uttarakhand CJ KM Joseph as New Judges for SC


According to Sources, Justice Aniruddha Bose from Calcutta HC would be Chief Justice of Delhi High Court, where Justice Gita Mittal is the Acting Chief Justice.

On Thursday, Supreme Court’s Collegium has recommended Senior Advocate Indu Malhotra and Uttarakhand Chief Justice KM Joseph be made judges of Apex Court.

At a meeting on January 10, CJI Dipak Misra and his four senior-most colleagues promoted six judges as Chief Justices of High Courts, including the one for Delhi HC.

Once Centre clears the two appointments, vacancies in Supreme Court would come down to four. There are 25 judges in Supreme Court against a sanctioned strength of 31.

Appointments were cleared almost a week after Minister of State for Law and Justice, PP Chaudhary told Parliament that Government had received no recommendation from Collegium to appoint the judges to Supreme Court.

Court vacancies have been a matter of bitter feud between the government and judiciary, who disagree on the procedure of appointment of the country’s top judges.

Senior Advocate Indu Malhotra, specialises in arbitration, will be first woman lawyer to be directly appointed to Supreme Court.

In 2007, she was only the second woman to be appointed as a Senior Advocate by Court, three decades after Leila Seth made history.

Justice R Banumatahi is the only woman judge in Supreme Court.

Justice Joseph, who was on Bench that in 2016 quashed imposition of President’s Rule in Uttarakhand, has been awaiting transfer to Andhra Pradesh for almost a year.

Collegium has promoted six judges, number of High Courts with Acting Chief Justices is now down to three.

Justice T Radhakrishnan would be moved to Andhra Pradesh HC from Chhattisgarh HC. Gujarat HC’s Judge Justice Abhilasha Kumari, daughter of Congress leader Virbhadra Singh, would be the next Chief Justice of Manipur.

Collegium confirmed senior most judge of the Calcutta HC, Justice J Bhattacharya, as Chief Justice since he retires in September,2018.

Justice Antony Dominic would be Kerala High Court Chief Justice till his retirement in May,2018 when he turns 62.

Collegium has moved Justice Ajay Rastogi from Rajasthan HC to Tripura HC.

Justice PD Rajan from Kerala HC and Justice Diwakar from Chhattisgarh HC have been moved to Allahabad HC on Administrative grounds.
