The Misbehavior with lady judge: HC bars advocate from practising in any court; directs police to ensure lady judge’s safety, Read Order , in In Re Of The Hon’ble High Court, debarred an advocate from practising law in any court in the state of Uttar Pradesh till the next date of hearing on account of dilatory tactics used by him to prolong the contempt case against him filed on reference by a lady judge, with whom the contemnor misbehaved.
The said case was registered in reference to the High Court under Section 15(2) of the Contempt of Courts Act, 1971, by a lady judicial officer posted at the outlying court at Khurja in the Bulandshahr Judgeship. She alleged criminal contempt committed by the contemnor, in her court while she was holding the court proceedings.
The matter had been adjourned several times. The Special counsel appearing for the High Court brought on record communication sent by the same Officer informing of the subsequent conduct of the contemnor in insulting her; obstructing the court proceedings and also hurling abuses against her. The judge eventually had to rise from her dais and take shelter in her chambers. Apart from this, there was another instance where she insulted and misbehaved with, publicly, and threatened the contemnor.
Till date, no reply has been filed by the contemnor. On the date of the hearing, an adjournment was sought by the contemnor. The Court thus observed, “Dilatory tactics are being adopted by the contemnor while seeking adjournment before this Court. The contemnor allegedly has acted most irresponsibly and his conduct leaves much to be desired. We cannot allow the rule of law to be thrown to the winds at the hands of an unscrupulous contemnor. Acts of intentional disrespect to a lady Judicial Officer will have to be viewed seriously and dealt with strictly or else the judicial system would collapse.”
Subsequently, while invoking their jurisdiction under Chapter XXIV Rule 11 (2) of the Allahabad High Court Rules, the court prohibited the contemnor from practising law in any court within the State of Uttar Pradesh till the next date of hearing. The Court also directed the Senior Superintendent of Police, Bulandshahr to provide safety to the lady judge. The Court further directed the District Judge to take action for the safety of the judge and also ensure the proceedings of the court were not hampered.
